Toyota says it fixed 2010 Prius brakes in production

Toyota said Thursday that it fixed a brake problem last month on 2010-model Priuses in production, raising questions about whether the company broke federal law by not reporting the issue to the government as a safety defect.Automakers often make changes during production to address complaints. But a safety defect must be reported to the National Highway Traffic Safety Administration.

“If the brakes aren’t working when you push on the pedal, that’s a safety defect,” says Bill Boehly, a former NHTSA associate administrator for enforcement, who oversaw defect investigations. Boehly notes that a car goes 88 feet per second at 60 miles per hour, so a one-second lapse is serious
